PROMOTION UNBLOCKED – LABOUR COURT BACKS IMATU !!
Promotion denied. Excuses given. IMATU took action!!
Our member had the experience. He previously held a similar post. He ticked every box. But when the City of Cape Town failed to shortlist him for promotion, IMATU’s Cape Metro Region took the matter to arbitration and won.
When the City launched a Labour Court review to try and overturn that victory, IMATU fought back and won again.
The Labour Court found that our member was unfairly excluded:
- He met all the requirements to be shortlisted.
- The City failed to recognise his prior relevant experience.
- The arbitrator correctly found that his exclusion was an unfair labour practice
The Labour Court dismissed the City’s review application and confirmed that our member is entitled to compensation.
This case is a reminder that IMATU doesn’t back down from unfair appointments. We fight all the way to the Labour Court, and we deliver results.
