Increase in BCEA Annual Earnings Threshold – 1 March 2023
The Minister of Employment and Labour has increased the BCEA’s annual earnings threshold to R 241 110.59 per annum (R20 092.55 per month).
This is up from the previous threshold of R 224 080.48 per annum.
The new earnings threshold comes into effect on 1 March 2023.
Employees (not otherwise covered by collective agreements) whose earnings are above the annual earnings threshold are excluded from sections 9,10,11,12,14,15,16,17(2) and 18(3) of the BCEA, section 198B of the LRA as well as section 6 (Aa) (ii) of the Employment Equity Act. Collective agreements that provide more favourable benefits and protections than contained in Chapter 2 of the BCEA will take precedence over the minimum protections set out in the BCEA including the earnings threshold.
