IMATU DELIVERS ANOTHER WIN: ACTING ALLOWANCE SECURED
No free labour under IMATU’s watch!!
When the City of Cape Town tried to avoid paying our member an acting allowance, after he stepped up and acted in a higher position for over a year, IMATU’s Cape Town Region took action, and won.
Our member, a Senior Superintendent in the Energy Department, took on the extra responsibility and acted as a Coordinator for 13-months. He did the job and delivered the results. But when it came time to pay, the employer said, “Sorry you don’t have the right qualifications”. That’s when IMATU stepped in and took the fight to arbitration. The Commissioner agreed and found:
- The employer’s refusal to pay our member an acting allowance was an unfair labour practice.
- The employer’s qualification requirement was just a guideline, not a strict rule.
- Other employees who acted in the same position, without the qualifications, were paid an acting allowance.
- The employer could have approved a deviation but chose not to.
- Management failed to submit a motivation for a deviation, and that’s not our member’s fault.
- The employer benefited from our member’s work for 13-months without fair compensation, this was unfair and unjust.
The employer was ordered to pay our member his full acting allowance for the entire 13-months.
This case is a clear reminder: employers can’t take the work and deny the pay!!
