DISMISSAL DEFEATED – ANOTHER LABOUR COURT WIN FOR IMATU !!
No legal failure is ignored under IMATU’s watch!!
When the Moretele Local Municipality dismissed our member, for allegedly leaving work without permission and failing to follow a supervisor’s instruction, the arbitrator sided with the employer and upheld the dismissal as fair.
But IMATU’s North-West Region didn’t accept a flawed ruling, they challenged it in the Labour Court and won it back.
The Court found the arbitrator got it wrong on every key point:
- He accepted hearsay evidence over solid facts.
- He ignored inconsistencies in the employer’s version.
- He failed to consider our member’s clear and consistent evidence.
- And worst of all – he shifted the goalposts by deciding the case on issues our member was never even charged with.
- The Labour Court ruled that the award was unreasonable and legally defective. IMATU won the review, and the award was thrown out. Our member will now get a fair hearing before another arbitrator, with IMATU by his side.
- This case shows: IMATU doesn’t stop when a case goes against our members. We dig deeper, we fight harder, and we win where it counts.
